Minua lähestyttiin Kiinan CN-verkkotunnusten rekisteröintiä vastaavasta
toimistosta. Sähköpostissa tiedustellaan mielipidettäni, sillä joku on
hakemassa CN:n alle verkkotunnusta, joka muistuttaa omaani.
Rekisteröijä pyytää minulta mielipidettä (!) asiassa.
Koska minulla ei ole ollut vastaavaa tilannetta aiemmin, ajattelin
pyytää hieman kommentteja ja neuvoja.
Tein jo alustavan vastauksen. Se näkyy tuolla alempana, mutta ensin
rekisteröijältä tullut viesti (yhteystietoja sutattu):

which is the domain name register center in China.I have something need
to confirm with you.
We have received an application formally, one company named
"[xxxxx] Investment(China) Co.,Ltd" applies for the domain
names(www.xtelnet.cn www.xtelnet.com.cn etc.) ,and the Internet
keyword(xtelnet) on the internet October 09, 2007. We need to know the
opinion of your company because the domain names and keyword may relate
to the usufruct of brand name on internet.
We would like to get the affirmation of your company, please
contact us by telephone or email as soon as possible.

I appreciate that you have approached me. Since I am not familiar with
the .CN top-level domain registration rules, I am not able to refer to
them in my answer. Here are just some of my thoughts:
The domain (xtelnet.com) is registered for my company X-Telnet Oy
located in Finland and regulated by Finnish and European Union trademark
laws in harmony with international treaties.
However, the top-level domain .COM, as far as I know, is a kind of "wild
west", where almost anything goes.
When I registered the domain name xtelnet.com, nobody checked if I
actually own a company or trademark allowing me to use this domain name.
So the domain "xtelnet.com", being registered for my company X-Telnet
Oy, does not imply any legal ownership-relation, as far as I know.
On the other hand, the domain registry of Finland (.FI) has strict rules
regarding trademarks, company names and who can gain a domain name and
who don't. Actually, I might change my domain to "xtelnet.fi" later.
I do not see any problems in letting a company own a domain
"xtelnet[.country-TLD]" if the company has ownership for a similar
trademark locally.
If the company does not have a trademark, subsidiary etc. referring to
the domain name, then, as my opinion it should _not_ be allowed a domain
name, which makes users assume it has (and especially, if such company
domain name could be mistakenly confused with existing, similar name).
So my short answer: In my opinion, the company in question should not be
given rights to use the word "xtelnet" as a keyword or as the 2nd level
word in a domain name if it does not have rights to the name already.
On the other hand, I will not take any action if such domain names would
be registered for the company in question.
As I said earlier, I am using the local Finnish law as a reference point
in my answer. I understand that the Finnish law does not apply in China,
so this should be taken only as my advice and opinion.
